A DRUNK man kicked a window so hard he smashed it during a night out.

Dominic Andrews, 25, appeared at Worcester Magistrates Court charged with criminal damage after kicking the window of an Evesham clothes shop.

Prosecuting Leslie Ashton said: “In the early hours of the morning on November 11, police officers were aware of damage caused to the entrance of Peacocks shop.

"The defendant who was located a short distance away was responsible.”

“When police attempted to arrest him he said, ‘I smashed a window, it’s not as though I burgled the place.’”

“CCTV showed images of a man leaning on the front door and then kicking at it until one of the panes broke.

“During the course of the interview the defendant was asked if he had made the statement and he said he didn’t, but said he couldn’t remember much.

"He described himself as being drunk.

“He said he has mental health issues having been diagnosed with anxiety.”

“He has pleaded guilty to criminal damage today.”

Mark Sheward, defending said: “He accepts his responsibility. What he said in interview makes no difference.”

“He had been out drinking.

"He stood by the door, kicked backwards and broke the window.

“It was not a premeditated offence and not something that involved a group or any other aggravating feature.”

The court heard that Andrews, of Oak Tree Close, Evesham is living with his mother and is on universal credit.

The magistrate Ian Strongman said: “There are no aggravating features but you have been in trouble quite a lot in the past.”

Andrews who appeared in court on November 28 was fined £100 and made to pay £100 in compensation to Peacocks to cover the cost of the repair of the broken glass.

He was also made to pay £135 in costs.

He was given credit for his timely guilty plea.
