IT has been claimed that Shropshire Council could have won a judicial review over a scheme to build more than 100 houses in Ludlow.
The scheme to build 137 houses in Foldgate Lane was originally refused but this was overturned on appeal.
Shropshire Council decided to take no further action but Andy Boddington who represents Ludlow North on the authority believes a judicial review could have been won.
He says that a case involving a scheme in Wem makes him believe that a challenge over the Ludlow development could have been successful.
“The planning inspector’s decision was obviously flawed and he failed to take account of the local plan, SAMDev,” claimed Andy Boddington.
“But, just as the council closed down for Christmas, it announced that it would not challenge the decision in the High Court. Now, an appeal in Wem shows just how strong the council’s case would have been.”
